Terms of Service
Terms for the 14-day free trial, paid subscriptions and use of the Nesting optimisation application.
Service provider
373 Nesting is supplied by Rush Creek Pty Limited, trading as Software373 (ABN 20 082 555 066). These terms apply to access to the Nesting website, accounts and online cutting optimisation application.
Trial and registration
New eligible accounts may receive a 14-day free trial. No credit card is required to create a free-trial account, and creating an account alone does not start a paid subscription. Trial access and feature limits are described in the application or on the pricing page. When the trial ends, some functions may become unavailable unless you choose a paid plan. You are responsible for keeping account details accurate and protecting your login credentials.
Paid plans, currency and GST
The currently advertised monthly plans are Starter — AUD $9 and Professional — AUD $19. These Australian prices include GST. All amounts displayed here are in Australian dollars. Any applicable taxes or charges for customers outside Australia should be checked in the payment screen before subscribing. Billing begins only when you deliberately choose and authorise a paid subscription through checkout.
Renewals, cancellation and refunds
Paid subscriptions are recurring and renew according to the billing interval presented at checkout unless cancelled. You can manage or cancel a paid subscription using the billing controls available in your account, or contact support@software373.com. The payment portal will show relevant subscription and cancellation details. We handle refunds and remedies in accordance with applicable law. Nothing in these terms excludes, restricts or modifies any consumer guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Permitted use and account responsibility
Nesting is provided to help users plan rectangular sheet-material cutting layouts. You may use the application for your own lawful business purposes, subject to the limits of your plan. You must not seek unauthorised access, disrupt the system, scrape private customer data, distribute malicious content or use the service unlawfully. You are responsible for activity through your account, except to the extent caused by our failure to meet legal obligations.
Your jobs and output accuracy
You retain rights in the data, drawings, sheet information and job details that you input into Nesting. You permit us to process and store that information to provide the service. Optimisation results, reports, offcut calculations and exports are planning aids; you must independently check dimensions, material suitability, kerf and machining settings before production. Nesting does not replace workshop safety procedures or professional judgement.
Intellectual property
The Nesting application, software, branding and documentation remain the property of Rush Creek Pty Limited or its licensors. Subject to these terms and your plan, we grant you a limited, non-exclusive right to access and use the hosted service while your account is permitted to do so. You must not copy or redistribute the application itself without authorisation.
Availability and changes
We aim to provide a reliable service but may need to perform maintenance, correct faults or update functionality. Where practicable, we will take reasonable steps to minimise disruption. Plan features or terms may change over time; material changes will be communicated where required by applicable law. If you have concerns about a change, contact support.
Liability and applicable law
Nothing in these terms limits rights or remedies that cannot legally be limited. Subject to those rights, we are not responsible for losses arising from unchecked cutting plans, incorrect customer inputs or unauthorised use beyond our reasonable control. Australian law applies to these terms, subject to any mandatory rights you have under applicable local law.
